TERMS OF SERVICE

Ripples On The Web provides World Wide Web page hosting. Ripples On The Web reserves the right to suspend or cancel a customer's access to any or all services provided by Ripples On The Web when Ripples On The Web decides that the account has been inappropriately used or otherwise.

COPYRIGHT

Any website created by us remains the property of Ripples On The Web until full payment is received whereupon title to the website, its content and copyright is passed to the client. From time to time Ripples On The Web will use data, code, images or programs (most of which has passed into the public domain) from other sources. As such, Ripples On The Web does not own the copyright and therefore cannot assign copyright to any third person. In this case the client will have the right to continue using this material but will not own the copyright of that material.

EMAIL

No client will use any of the services we provide to send any bulk unsolicited e-mail (SPAM) or to receive replies to any bulk unsolicited e-mail sent by any other means, or use bulk unsolicited e-mail to drive visitors to the clients website. Because our upstream conectivity providers demand it, this rule is enforced rigidly. Contravention of this rule could render the clients agreement with us void and the clients website liable to deletion from our servers. DNS operations for the domain name will also be discontinued and no refund of any fees paid will be due

LIMITATION OF LIABILITY

Whilst Ripples On The Web will endeavour to ensure that any goods or services supplied will meet all legal requirements, it is the customer's responsibility to ensure that pages and images are not libellous and do not infringe copyright or other intellectual property rights. The customer hereby agrees to indemnify and hold Ripples On The Web harmless from any legal actions which result from the content of customer pages. The customer shall defend and pay all costs, damages, awards, fees (including reasonable legal fees) and judgements finally awarded against Ripples On The Web arising from such claims and shall provide Ripples On The Web with notice of such claims, full authority to defend, compromise or settle such claims and reasonable assistance necessary to defend such claims at the customer's sole expense.

Ripples On The Web reserves the right to immediately temporarily remove hosted web pages and/or images on sites which Ripples On The Web controls if it has reason to believe the pages or images may be illegal or in breach of intellectual property laws pending further investigation. No reimbursement will be made for any period when pages or images are unavailable for this reason. No charge will be made for restoring any pages or images which are found, after investigation, to be non-infringing.

Ripples On The Web reserves the right to immediately permanently remove hosted web pages and/or images on sites which Ripples On The Web controls if it has reason to believe the pages or images are illegal or in breach of intellectual property laws. No reimbursement will be made for pages or images which are removed. Replacement of infringing pages or images by non-infringing pages or images will incur further charges.

Ripples On The Web reserves the right to immediately temporarily suspend or permanently remove hosted web pages and images, and to terminate any other service provided, in the event that the customer is in arrears with payments.

Ripples On The Web reserves the right to claim a right, equivalent to a lien, over web space and/or domain names purchased on behalf of the customer in respect of any customer debt.

Ripples On The Web reserves the right to give three months' notice not to renew any contract for ongoing services. No reason need be given for this termination.

Internet services are provided on an ongoing basis with all payments due in advance of service. All charges are deemed contracted for a period of 12 months from the initial installation or setup. Cancellation of service may be made by giving 3 months notice in writing. If the customer terminates this contract before the end of the initial period, then Ripples On The Web will debit the customer's account with a sum equal to the charges otherwise due for the remainder of that initial period. If, after the period, the customer terminates this contract without giving the required notice, then Ripples On The Web will debit the customer's account with a sum equal to the charges otherwise due for the notice period.

SERVER USE

Hosting accounts are to be used by the primary owner only. Hosting account holders are not permitted resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners.

Ripples On The Web reserves the right to refuse service and /or access to its servers to anyone.

Ripples On The Web do not allow any of the following content to be stored on its servers:

Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.

Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Ripples On The Web.

Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

Ripples On The Web services may only be used for lawful purposes. It is the customer's responsibility to ensure that material is not in contravention of applicable legislation such as, but not limited to: pyramid selling schemes, material judged to be obscene, threatening or racially prejudiced in the following countries:
The United Kingdom, where Ripples On The Web is situated.

The country where the customer's domain is registered.

The country where the web server resides.

Countries where the customer's services/products are available.

Countries where the content of the page may be illegal.

UNLIMITED USE POLICY

High bandwidth usage: Ripples On The Web may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, Ripples On The Web reserves the right to impose the High Resource User Policy for the consideration of all customers.

HIGH RESOURCE USER POLICY

Resources are defined as bandwidth and/or processor utilization.

Ripples On The Web may implement the following policy to its sole discretion:

When a website is found to be monopolising the resources available Ripples On The Web reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers.

PAYMENT POLICIES

All hosting accounts are set up on a prepay basis. Although Ripples On The Web reserves the right to change prices of accounts or services at any time, all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers will automatically be invoiced again at the end of their prepay period unless closure notification has already been given.

In situations where the invoice is not paid, Ripples On The Web will immediately suspend the hosted web site. In addition, Ripples On The Web reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.

All graphic and web design work undertaken will be on a 50% pre-payment at the agreed commencement of contracted work, with the balance payable on completion.

All payment is in UK sterling.

PAYMENT OPTIONS

Payment can be made by cheque. All cheques to made payable to Ripples On The Web Limited.

CANCELLATION AND REFUNDS

Ripples On The Web reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. If a customer contravenes Ripples On The Web terms of service a refund will not be issued in the event of a cancellation.

Customers may cancel their hosting account at any time.

Fees charged on a prepay basis are non-refundable. Customers are not entitled to receive a refund unless the service is cancelled by Ripples On The Web.

INDEMNIFICATION

Customer agrees that it shall defend, indemnify, save and hold Ripples On The Web harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Ripples On The Web, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Ripples On The Web against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Ripples On The Web' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Ripples On The Web' server.

DISCLAIMER

Ripples On The Web will not be responsible for any damages your business may suffer. Ripples On The Web makes no warranties of any kind, expressed or implied for services we provide. Ripples On The Web disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Ripples On The Web and its employees. Ripples On The Web reserves the right to revise its policies at any time.
